Plaintiffs did not live there and did not enter the building. While they were resting, officers who were executing a search warrant in that apartment came downstairs and arrested Plaintiffs for no reason. One of the officers violently pushed the female plaintiff, who was pregnant at that time, because she was not moving fast enough. They were taken to the precinct and placed in a cell. Officer Jeffrey Michaels, with the acquiescence and approval of other officers, falsely alleged in police reports that Plaintiffs lived in that apartment and were therefore in possession of the illegal drugs found in the apartment. He further misrepresented that the female's Plaintiff's benefit card was found in the apartment. The female plaintiff was released on her own recognizance and the male plaintiff was sent to Rikers Island and posted bail one week later. The criminal charges against them were dismissed on September 27, 2012.
