Defendant Officers Price and Lee-Shue were in a marked car when they stopped and ordered Plaintiff out of the vehicle in which he was sitting. Defendant Officer Price pulled Plaintiff from the vehicle and thrust his head and face onto the cars trunk. While handcuffed Defendant Price deployed pepper spray to Plaintiff's face and put Plaintiff in the back of the patrol car. Plaintiff, agitated by the spray was spitting, this further offended Defendant Price who again deployed pepper spray. Defendant Price complained about Plaintiff's reaction to the pepper spray and struck him in the torso repeatedly while twisting Plaintiff's handcuffed wrist and hands. Defendant Officers took Plaintiff to the 41st precinct and made false statements and misrepresentations causing Plaintiff's prosecution.
