At the time, Mr. Lin was lawfully present at the location, when the defendants illegally approached him and assaulted\nand battered him by striking and/or punching him in the face approximately three (3) times causing Mr. Lin to experience substantial pain, a closed fracture the left-side jaw, a closed fracture of the nasal bone, laceration to the forehead, shock, and emotional distress, without probable cause, reasonable suspicion, valid search or arrest warrant, reason for the use of force, or any justification whatsoever as to unlawful conduct on the part of Mr. Lin.\n\nDefendant Wong then continued to batter and assault Plaintiff by striking and/or\npunching him about his person and then firing off several rounds from a handgun equipped on his person causing Plaintiff to experience substantial pain, extreme shock, and significant emotional distress. The Defendants, including Wong and Dobles then accused Mr. Lin of a criminal offense without probable cause, reasonable suspicion, or any justification whatsoever and proceeded to violently contort his arms behind his back so that they could apply metal handcuffs, disregarding Mr. Lin's complaints that the cuffs were placed on too tightly causing him significant discomfort and pain, which resulted in plaintiff's wrists and hands sustaining loss of feeling, redness, and swelling. The Defendants proceeded to\nconduct an illegal search of Mr. Lin's person without probable cause, reasonable suspicion, valid arrest or search warrant, or any justification whatsoever as to the commission of unlawful conduct on the part of Mr. Lin. Mr. Lin was then placed in a police vehicle and transported to New York-Presbyterian\nQueens Hospital located at 56-45 Main Street, County of Queens, City and State of New York where he treated for a closed fracture to the left-side of his jaw, closed fracture to his nasal bone, and a laceration on his forehead.
