Plaintiff protested saying that he had been drinking in the bar and was not in a state that he could legally operate his car. Defendants insisted that he move his car. Plaintiff protested that he feared that if he moved his car, he would be arrested for driving while intoxicated. Defendants nevertheless insisted that he move his car, and threatened to have Plaintiff’s car towed if he did not move it. When plaintiff moved his vehicle a minimal distance as directed by defendants, defendants then arrested, detained and held plaintiff. Plaintiff was then maliciously prosecuted by and at the direction of the said defendants. Officer Alicea was responding to a call from Dib's sister, who reported an argument she and Dib had prior to Dib leaving to purchase cigarettes.  Officer Alicea asked Dib to come with him, and Dib willingly agreed; notwithstanding Dib's surrender, Officer Alicea deployed a taser on Dib, striking him in his chest and left hip.  As a result of Officer Alicea's taser use, Dib fell to the ground and hit his head on a nearby curb.  Dib was taken to the hospital and treated for his injuries, and while at the hospital he was charged with four misdemeanors and a felony.  Due to the charges, Dib was unable to return to his home and had to live in a homeless shelter followed by a hotel. Several officers, including Officer Le Ber, Officer John Doe 2, and Officer John Doe 3 got out of the vehicle and grabbed Mr. Bishop. The police officers proceeded to kick and punch Mr. Bishop about his body and scraped his face on the floor. Mr. Bishop was handcuffed, thrown in the police vehicle, taken to the 122nd precinct, and was subsequently charged with robbery and remanded on Rikers Island. On April 19, 2012, all charges against Mr. Bishop were dismissed.\n\nOn July 27, 2013, at 8 pm, Mr. Bishop was cycling to the “Time Deli and Grocery” on Targee Street, Staten Island. Mr. Bishop approached the sidewalk and dismounted from his bike – he dismounted, parked his bike against the wall outside, and went in and bought a bottle of juice. As he was exiting, Mr. Bishop was approached by Officer Rosado who accused Mr. Bishop of cycling his bike on the sidewalk. Mr. Bishop told Officer Rosado that he did no such thing, and Officer Rosado asked for identification – Mr. Bishop complied. Officer Rosado then began to verbally and racially abuse Mr. Bishop. Mr. Bishop asked Officer John Doe 1 why Officer Rosado was behaving this way, and Officer Rosado proceeded to search Mr. Bishop – during the search, Officer Rosado placed his hands on Mr. Bishop’s genital area. Mr. Bishop expressed his distress at Officer Rosado’s conduct. Officer Rosado then instructed Mr. Bishop to put his hands up and both officers pushed Mr. Bishop against the wall. Officer Rosado punched Mr. Bishop in the face, lifted Mr. Bishop off the ground above his head and slammed Mr. Bishop onto the sidewalk. Both officers then jumped on top of Mr. Bishop while he was on the floor and proceeded to kick and punch his head and body. Mr. Bishop was able to free himself, but was caught and beaten again by the officers. Mr. Bishop was then handcuffed and taken to the 120th precinct and was held in a cell until 2:30 pm the next day. On July 28, 2013, at approximately 3:30 pm, Mr. Bishop was arraigned on charges of disorderly conduct, resisting arrest and obstruction of governmental administration.
