The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants applied excessively tight handcuffs, formally arrested and placed Plaintiff in a police vehicle and transported him against his will to the 81st Precinct. Plaintiff was transferred from the precinct to Central Booking where he was arraigned on a criminal complaint made on the basis of false allegations supplied by the defendants that Plaintiff was indicted by Defendant Laspina for the criminal offense of burglary on or about September 9, 2019; and that on April 14, 2020, they observed Plaintiff committing another crime or violation of the law which both were made without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification. PO Defendants also, while Plaintiff was in custody, prepared and filed false paperwork with the DA. As a result, Plaintiff was caused to be incarcerated over the course of approximately 1 year until his release eventual from physical custody on, or about, May 1, 2021.
