Plaintiff alleges that Police Officer Christian Valenzuela #19271, Police Officer Keenen Adam-Edwards #10378, and Police Officer Johnathan Diaz-Mojica #14105 violated his 14th Amendment rights by repeatedly showing his picture to a drunken Jordan Card and asking him if Plaintiff was the one who robbed him, in a manner that constituted suggestive identification. Later that day, Plaintiff alleges his rights were further violated when Police Officer Anthony Lafemina #11439 included the same single photograph as before in an array of photographs shown to Jordan Card. On or about the same day, Plaintiff alleges Police Officer Keenen Adam-Edwards #10378 falsified a police reports and the charges against Plaintiff by stating that Plaintiff was in possession of a box-cutter. Officer Adams-Edwards, Plaintiff alleges, continued to lie during his testimony of the Wade Hearing. On or about the same day, Plaintiff alleges that Officer Johnathan Diaz-Mojica #14105 falsified a police report and the charges against the Plaintiff by stating that Plaintiff robbed Jordan Card at knifepoint. Officer Johnathan Diaz–Mojica, Plaintiff alleges, continued to lie during his testimony of the Wade Hearing. Plaintiff alleges that Jordan Card testified to the grand jury that he did not see a weapon or any other object.\n\nOn or about August 22, 2015, at approximately 5:45 pm, Plaintiff alleges that he provided Police Officer LaFemina #11439 with his attorney's information and invoked his right to counsel, but that Plaintiff was denied his right to counsel in violation of his 6th Amendment Rights.\n\nOn or about August 23, 2015, Police Officer LaFemina #11439, Plaintiff alleges, attempted to have the Plaintiff partake in a police line-up voluntarily without providing Plaintiff with his attorney. Plaintiff alleges that after he refused to partake freely in the police line-up, Police Officer LaFemina and several other police officers assaulted Plaintiff and forced him to partake in the police line-up by handcuffing Plaintiff to the wall and placing leg irons on Plaintiff's ankles in violation of his 8th and 14th Amendment rights. Further, Plaintiff alleges that he was placed in position number four of the line up, the same slot Plaintiff had been placed in for the photo array.
