Defendant Officer Rodriguez told the Plaintiff that a neighbor reported that she had a weapon. Plaintiff told the Defendants that he does not have a weapon and that this same neighbor had been harassing her for some time, that Plaintiff had an order of protection against this neighbor, and that this neighbor filed false reports against her before. Other Defendant Officers then entered and placed Plaintiff under arrest, denying her the opportunity to put on warmer clothes as it was cold and snowing outside. Plaintiff was then dragged to the elevator and struck with a baton which resulted in fractured metacarpal bones. Plaintiff was again assaulted by a Defendant Officer in the elevator when one of the Defendants told her to \"shut up\" and pushed her face violently against the elevator wall. After her arraignment and release, Police told Plaintiff she should find some place to stay until things with her neighbor cooled down. During this time period several people informed Plaintiff that Police were inn and out of her apartment, and even had it pad locked. Plaintiff made several calls to the Police to find out what was going on but no one gave her any answers, including why the Police were in possession of the keys. When Plaintiff regained access to her home, it had been torn apart and several items were damaged.
