After the carjackers drove out of the parking lot, hitting a parked car, Plaintiff 1 called 911 and unnamed POs arrived. A friend of Plaintiff's had left his phone in the stolen car which allowed Plaintiff and officers to track the car to its location, parked illegally in an unsafe neighborhood. POs began to ask Plaintiff 1 to identify who carjacked him. Plaintiff 1 explained he did not see perpetrators' faces, but regardless POs began to line up nearby black men. Plaintiff 1 and his friends declined to falsely identify any individual because they did not see any faces. POs thereafter refused to assist with the ongoing investigation. Plaintiff 1 asked for the POs' help in moving his car, but POs told him because it was found it was no longer stolen and claimed they had to respond to another call, leaving Plaintiff 1 by himself in a high crime area. \n\nPlaintiff 1 requested a tow truck. While he was waiting Plaintiff 1's friend Plaintiff 2 arrived. Plaintiff 1 began to describe the events when PO \"John\" Kim arrived, whom Plaintiff 1 had seen in the neighborhood before. As Plaintiff 1 explained the situation to both individuals, his stolen car's lights began to flicker and windows began to move up and down. This indicated someone with the car's remote was nearby. PO Kim said \"that's creepy\" but declined to assist further and left the scene. After PO Kim left, Plaintiffs realized they had been parked in after Plaintiff 2 arrived. Shortly unknown masked individuals approached and shot at Plaintiffs and the cars. Plaintiff 1 played dead and called 911 once the individuals left. POs, including PO Kim, and ambulances arrived after some time.
