Surveillance video shows numerous police officers, including defendant NYPD officer Richard Haste and Sergeant Scott Morris, entered with guns drawn running to the front door of the premises, attempting to gain access. They had no arrest or search warrant, and the young man had committed no crime. Unable to gain access, the officers surrounded the building and tried a back entry when an 8 year-old opened the door to his first floor apartment. One of the defendant officers pointed the gun in his face and ordered the child out of his home. the 8 year-old's father, Plaintiff, came to the door and the officers again demanded entry, eventually pushing pass Plaintiff and gaining unauthorized access. Once inside, several other officers streamed into the premises and raced up to the second floor, where they broke into the young man's second floor apartment and entered with guns raised. The young man ran into the bathroom and Defendant Haste shot him in the chest, which caused him to immediately fall to the ground. The young man died of his injuries. Officer Haste shot and killed Plaintiff Ramarley Graham, who was unarmed. Officer Haste then threatened to shoot Graham's grandmother, Plaintiff Patricia Hartley, and several officers physically prevented her from making a phone call. Graham's mother, Plaintiff Constance Malcolm, was physically prevented from speaking with Hartley by NYPD officers who restrained and locked Hartley in a room. NYPD officers aggressively interrogated Hartley by cursing at her, pushing her make false statements, delaying access to her attorney, and refusing to allow her to leave for almost 7 hours.
