In order to protect himself from the assault, Plaintiff drove his car away from the assault to seek police assistance. Defendant Officers Albert Moulier, Vincent Arias, and John or Jane Doe 1-10 ignored Plaintiff's pleas for help and falsely accused Plaintiff of operating a motor vehicle while under the influence of alcohol or drugs and leaving the scene of an incident without reporting. Plaintiff informed the officers he was fleeing in terror, and at the time he notified the officers his vehicle bore clear damage from the attack. Defendant Officers falsely claimed that Plaintiff was involved in a hit and run accident, then left the scene of the accident, and that he was intoxicated. Defendant Officers conducted an illegal search of Plaintiff's person by patting them down and searching their pockets. Plaintiff was arrested and handcuffed, and Defendant Officers ignored pleas to loosen the excessively tight handcuffs. Plaintiff was transported to the precinct and later to Central Booking and subjected to additional searches. Defendant Officer Albert Moulier signed a criminal complaint against Plaintiff affirming the truth of the fabricated allegations that Plaintiff was operating a motor vehicle under the influence of alcohol or drugs and leaving the scene of an incident without reporting.
