He was held for more than 24 hours before arraignment, then selected from an in person lineup by Defendants Garcia and Goris.  Plaintiff was arrested, charged with felony gun possession, arraigned, and released on his own recognizance.   Defense counsel established during discovery that Plaintiff’s cell phone was miles away, there were alibi witnesses, and the DNA on the gun did not match Plaintiff, but notwithstanding these facts the Kings County DA continued to press charges.  Finally, in late 2013 a new ADA was assigned.
