Claimant then walked two blocks further and saw these officers again and pulled out his phone to take down their license plate number. Then 3 male officers and one female officer got out of the car.  Segeant Pinny assaulted the Plaintiff, forcefully grabbing his hands and putting handcuffs on his left wrist at which the second male officer came up behind him and grabbed his right arm attempting to put the cuffs on his right wrist, but the first male officer was now bending his left arm in a clockwise motion while tightening the handcuff to his left wrist, cuffing him in an excessively tight manner. The tightness caused blood loss to the hands and numbness, bruising and internal derangement to his left shoulder. Plaintiff had not resisted or assaulted the defendants in any way and such forced as was used against him was unnecessary, unreasonable and excessive. When she opened the door, she was confronted by PO lieutenant Brian Query, and police officers Macciel Restituyo, David Perez, Lissa Solermarte, Praveen Davis, Alex Almonte Pichardo, Jason Gonzalez, Daniel Reisert and Flamur Gashi. The officers, who had received a 911 call, demanded to speak with the nephew and then, without a warrant or consent, barged into the apartment. Once inside, lieutenant Query asked Lee where her nephew was, and she responded that he was in his room. The officers then approached the nephew’s room, and PO Solermarte, Query, and Restituyo drew their tasers, even though the nephew posed no threat. Plaintiff, hanging back, asked the officers not to tase her “child.” In retaliation, lieutenant Query instructed the officers to arrest Plaintiff for obstruction of governmental administration. The officers did so – and they refused to tell Plaintiff that she was under arrest while handcuffing her, taking her to a squad car outside and driving her to the local precinct. The officers held Plaintiff at the precinct and questioned her for hours. When her blood pressure rose alarmingly, she was brought to a hospital and shackled to a bed there for hours more. Plaintiff was arraigned on December 5, 2021, and released on her own recognizance. In support of the charges, prosecutors presented a criminal complaint signed by PO Restituyo on December 4, 2021, which contained multiple demonstrably false statements made by officers. After Plaintiff’s release, she faced prosecution for months before the DA dismissed the charges on May 18, 2022, “in the furtherance of justice”. The officers then struck plaintiff in the head, body and limbs, causing injury. Officers placed their knees on the plaintiff's body and ground the plaintiff's face and body into the street. PO defendants handcuffed the plaintiff, and bent his body in half, attempting to bring his feet towards the back of his head. Plaintiff was unlawfully arrested and taken to the 42nd Precinct in his underpants since his pants having fallen down his body during the assault, causing him further embarrassment. Plaintiff was thereafter transported to PSA-7 where he fell sick to the floor inside a holding cell. As a result of the defendant’s assault, plaintiff fell ill and was transported from the precinct to the Bronx Lebanon Hospital ER where he was treated and released and then transported back to PSA-7 shackles handcuffed. While plaintiff was in the custody of the defendants, defendants prepared and filed false paperwork against plaintiff. At plaintiff’s arraignment, the judge imposed $75,000 bail based on the officer’s false paperwork, which plaintiff could not afford. As a result, the plaintiff was unlawfully imprisoned until approximately August 17, 2021.
