Later that day Sergeant Rajan and other POs were waiting for Plaintiff in front of his house, at which time Plaintiff presented his passport and boarding pass proving he was out of the country at the time of the alleged incident with Plaintiff's mother. Regardless, Sergeant Rajan used pretense to enter Plaintiff's house and directed Plaintiff to present the rifle. Thereafter Sergeant Rajan and other POs unlawfully trespassed in Plaintiff's basement and bedroom to search without legal justification or Plaintiff's consent. \n\nIn those rooms POs found safes that Sergeant Rajan directed Plaintiff to open. One contained the rifle at issue, which was properly registered, and both contained other guns not properly registered due to an administrative error. POs did not identify and Plaintiff did not own or possess the alleged revolver at issue. Regardless, Sergeant Rajan and POs detained and arrested Plaintiff without legal justification on the alleged basis of improper weapons registration. Plaintiff was handcuffed and taken to the 115th Precinct then Central Booking. During this Plaintiff was criminally processed and wrongfully questioned. Plaintiff was in custody approximately 28 hours.
