Plaintiff had pulled over the vehicle to examine the tire when several unidentified NYPD officers, including Delton Ng, Alfred Foy, and Does 1–10, approached him. They unlawfully searched him, despite having no reasonable suspicion or other lawful basis to do so. They then assaulted, battered, and used excessive force on plaintiff, throwing him to the ground, punching and beating him, and breaking his watch in the process. The officers recovered no contraband from plaintiff. Despite having no probable cause to believe plaintiff had committed any crimes or offenses, the officers placed plaintiff in handcuffs and under arrest. They physically forced him into a police car and slammed the car door on his foot, causing injury. Plaintiff was taken to the precinct, where the officers falsely informed the DA that they had observed plaintiff commit various crimes/offenses. At the precinct, plaintiff requested medical attention multiple times, but his requests were denied by the officers. Plaintiff was taken to Central Booking, arraigned, and finally released from custody, whereupon he received medical treatment for his injuries.
