The officers, including defendants Clinton, Perez, Kovalik, Bemudez, and Ciota then sprayed plaintiffs with pepper spray, blinding plaintiffs and knocking Plaintiff Richardson to the ground. No defendants attempted to give medical assistance to plaintiff Richardson. Meanwhile, defendants Taylor and Calderon arrested plaintiff Myrie without probable cause and refused to offer him medical assistance. Defendant officers Kovalik, Ciota, Bermudez, Ventrella, Olfano, and Kerr failed to intervene in the unlawful conduct against both plaintiffs. Plaintiff Myrie was eventually identified as an elected official and was released from custody. The plaintiffs then left the scene of the protest.
