(Henisha Toppin’s 10-year-old son), were subjected to false arrest, false imprisonment and detention, illegal taking of property, loss of parental rights, assault and battery and use of excessive force, for acts of which plaintiffs were innocent. On the incident date, Plaintiffs were having a New Year’s Eve celebration at Toppin’s mother’s home in Brooklyn. At approximately 3:00 a.m., Several police officers arrived at the location and knocked on the door.  When no one inside answered the door, police officers remained on scene and refused to leave. At approximately 5:00 a.m., the all three plaintiffs exited the location and were arrested and taken to the 69th Precinct without probable cause.\n\nWhile in police custody, Plaintiff Jones was forced to stand outside in the extreme cold wearing only boxer shorts on her lower extremities and wasn’t provided pants for several hours after arriving at the police station. During the arrest, Police officers took Toppin and Jones’s cell phones and never returned them (illegal taking of property/conversion). Plaintiff Jones was held in police custody for approximately 48 hours and was never charged with a crime. Plaintiff  Toppin was subject to a humiliating search at the police station in front of her 10-year old son and was held in custody for over 24 hours. J.T. was released to his grandmother and was never charged with a crime. Toppin was eventually charged with Criminal Possession of a Weapon. The Kings County DA’s Office later dismissed all of the charges against her. As a result of the unlawful arrest, Toppin was required to attend family court hearings concerning her custody of J.T. Toppin lost custody of her son J.T. and J.T. lost his right to live with his mother for an entire year (loss of parental rights). J.T. suffers from nightmares because of the actions of the defendant police officers that caused him to be separated from his mother.
