While Plaintiff was lying on the ground injured, Defendant NYPD John Doe Officer 1 turned on the engine of an NYPD SUV that Plaintiff was lying near, thereby causing Plaintiff to breathe noxious fumes. Plaintiff was taken away in an ambulance due to his injuries and the acts of Defendant Gayle and Defendant Vivas. To attempt to cover up their assault of Plaintiff, Defendant Gayle, arrested Plaintiff for invented criminal charges. Defendant Vivas, who was also responsible for assaulting Plaintiff, approved of Defendant Gayle’s arrest of Plaintiff. The charges against Plaintiff were false and brought with malice. \n\nWhile in the custody of Defendant DOC in the Bronx, Plaintiff repeatedly complained to Defendant DOC John Doe Officers 1-10 about his back injury and extreme pain as a result of the injury caused by Defendant Gayle and Defendant Vivas.
