P.O. noted to her that her car was in repossession. Then, Plaintiff explained that her bill was due but not yet past due. Nonetheless, P.O. began shouting at the Plaintiff to get out of her vehicle, flashing their blue lights and shining flashlights in the Plaintiff’s face. The Plaintiff asked not to do it, saying she has been diagnosed epileptic since 2011. P.O. busted out the rear passenger window of the vehicle with the backs of their flashlights, spraying broken glasses all over the Plaintiff and the inside the vehicle, and then began pulling her out of the car through the rear window. P.O. dragged her through broken glass and then threw her to the ground. The Plaintiff was tased twice in the stomach and began to have a seizure as she lay on the ground. P.O. unlawfully pat-down search and tightly handcuffed her. At no time did Plaintiff commit a crime or violate the law. The Plaintiff was transported to Woodhull Hospital, where her clothes were removed, and she was handcuffed to a hospital bed while being treated for her many wounds, the result of broken glass in her eyes, buttocks, and across her entire left side. After 5 hours at Woodhull Hospital, Plaintiff was placed in the back of an NYPD vehicle and transported to the 88th Precinct. Thereafter, Plaintiff was transported to Kings County Central Bookings, where she was again processed and placed in a holding cell. Due to P.O.’s false statement, on June 23, 2022, Plaintiff was arraigned in criminal court, charged with crimes of unauthorized use of a vehicle, criminal possession of the stolen property, resisting arrest, and obstructing government administration that she did not commit.
