The officers approached him and asked him why the he had his children in their child seats outside, and Ellis told them that it was too hot inside his truck and he wanted to have some air underneath the shade provided by the fence. The officers then told him that if he played smart with them, they would have his children taken away. The officers then ordered him to sit on the bumper of his truck while they ran his name and searched the vehicle. Ellis told the officers that he was waiting for his sister to pick the children up to take them to their mother when she gets off work. Then Harris searched Ellis, and despite not finding anything, arrested him for the unlawful possession of marijuana. The children were transported to the Long Island Jewish Hospital, and Harris and Nash called the office of Administration for Children's Services to misrepresent to them that plaintiff was endangering the welfare of the children. \n\nWhile Ellis was at the precinct, officers verbally harassed him by calling him a \"sex offender\" and a \"pedophile.\" Ellis requested a form to file a complaint against the officers, and in response the officers claimed he needed a psychiatric evaluation and transported him to Queens Hospital, where doctors confirmed there was nothing wrong with him. Officer Harris and Lietenant Morabito provided false statements to the Queens DA , leading to plaintiff being charged with endangering the welfare of the children and possession of marijuana. He was unable to post bail, and remained in Rikers Island for 10 days until bail was vacated.
