Those protesters had gathered at a protest against George Floyd's murder in the Mott Haven neighborhood of the Bronx, where NYPD officers blocked all exits of a protest group on 136th street before 8:00 PM to effectuate mass arrests of protestors for violating curfew after 8:00 PM, using force including striking protestors with batons, deploying pepper spray, and arresting National Lawyers Guild - New York City Chapter Legal Observers and medical volunteers. Plaintiff began filming the arrest of the dispersing protestors, and can be heard on the video telling the citizens to not resist arrest. Then, the unidentified NYPD officers came toward Plaintiff in retaliation for recording. The officers then, without issuing a dispersal order, violently detained and arrested Plaintiff by pushing him aggressively; throwing him down to the ground; kicking, punching and hitting Plaintiff with batons while on the ground; and hitting Plaintiff in the stomach with the end point of a baton. Plaintiff was forced onto his knees, with one officer crouching on Plaintiff's knee while another officer hit him repeatedly with fists. During this beating, other officers attempted to disperse onlookers. At one point, Plaintiff's slippers came off, rendering him barefoot. He was detained with heavy-duty zip ties, that were tied tightly on his wrists. Then, plaintiff was dragged by an unidentified offer to a police van, taken to the precinct, and issued a summons for violating curfew. The summons was dismissed.  Plaintiff had significant bruising and scraping from the incident and went to the hospital for his injuries.
