After feeling light-headed, he safely pulled over the truck and passed out. Defendant NYPD officers arrived at the scene and, despite being informed by FDNY EMTs that Mr. Kern required medical care, Defendant Officer Michael Slinkosky decided to arrest him. Defendant officers transported Plaintiff to the hospital while he was unconscious. At the hospital, Defendant Officer Ryan Barber attempted to force Plaintiff to consent to a blood test refusal, despite knowing that Plaintiff was in a medically unstable condition and unable to consent. He repeatedly pushed and grabbed Plaintiff's arm and shoulder, shaking him and yelling his name. Plaintiff's blood test results returned negative for any drugs. He was handcuffed during his time at the hospital. 2 days later, Plaintiff was booked and placed in a holding cell for approximately 7 hours.
