Plaintiff was forcibly takne against his will, imprisoned by detective Cavada at the 105th precinct, held in confinement, forced to have his fingerprints taken, had a DNA sample taken, and was photographed. Plaintiff was then interviewed by detective Cavada where he vehemently denied any involvement in or any knowledge of the credit card fraud transactions. Detective Cavada had ample time to observe plaintiff's appearance and to compare it against the unidentified persons in the surveillance video, as there were multiple visible differences between the people in the video and plaintiff. After several hours, plaintiff was ultimately released. On Auguest 23, 2016, detective Cavada signed a sworn criminal information alleging that plaintiff committed further misdemeanor and felony offenses in addition to the credit card fraud crime. Plaintiff was arraigned and indicted on the crimes from the sworn criminal information document. Eventually three of the four perpetrators from the credit card fraud offense were caught however detective Cavada never made any attempt to ascertain whether those three individuals worked with or even knew plaintiff, nor did detective Cavada present any independent evidence linking plaintiff to the three men in any way. Further, it is alleged that detective Cavada and/or assistant district attorney withheld exculpatory evidence, most notably the surveillance footage that showed the visual discrepancies from the perpetrator's appearance and plaintiff's appearance. The bouncer demanded payment of the entry price and an additional separate payment to himself for Plaintiff and his friends to gain access. Plaintiff was willing to pay the entry price but not the additional amount, which led to a heated exchange with the bouncer. Two police officers, including Officer Darrin Smalls, then arrived and told Plaintiff to step out of line if he was unwilling to pay. Plaintiff attempted to explain the situation, and Officer Smalls tried to push him out of the line. As Plaintiff tried to continue to explain, Officer Smalls slapped Plaintiff and Plaintiff's friend, Wilkin Brown, stepped in between Smalls and Plaintiff. Plaintiff then decided to leave and began walking away, as another police vehicle with several officers arrived. Smalls pursued Plaintiff and struck Plaintiff in the back of the head with his baton, opening a head wound which began bleeding. Plaintiff fell to the ground unconscious. Upon release from the hospital, Plaintiff was arrested and charged with Assault in the Second and Third Degree, Resisting Arrest, Obstructing Governmental Administration in the Second Degree, and Disorderly Conduct.
