Plaintiff was also tasered and struck. Defendants hit plaintiff's head, pounded his head and body into the street. Plaintiff was also wrongfully arrested. The criminal charges were dismissed on August 12, 2024. Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account.
