The demonstration was orderly and calm, however more police started to arrive to the protest and by 5:25 PM there were fifty police officers including all named defendants, Inspector Dowling, Deputy Inspector Hillery, PO Cascio, PO Cirikiovich, PO Dottavio, PO Johnson, PO Monestine, PO Mosquera, PO Olivares, and PO Singh. At about 5:27 PM, the PO's made an inaudible annoucement over a loudspeaker as Bensmaine noticed other protestors continue to make their way toward 47th street where the officers were located. At 5:27 PM, Bensmaine was in at the crosswalk at 47th street and 7th avenue where he waited for people in front to move out of his way, so he decided to take some photographs of the protest. Bensmaine alleges he was suddenly tackled by at least five of the defendant officers, who then piled on top of him and showed his face into the concrete. Eventually some officers got off of him and Bensmaine attempted to gather himself off the ground and retrieve his credit cards that were spread out on the street when the officer directly on top of him used his baton to push Bensmaine further into the concrete. Several officers crowded around Bensmaine while this was happening without intervening, which also made it difficult for other protestors to see what the POs were doing to Bensmaine. Bensmaine alleges he was violently and tightly zipped tied, then had the zip ties removed only for handcuffs to be tightly placed on his wrists instead. Plaintiff was shot in his right arm, lower back, and through the backs of both of his legs. A bystander whom Plaintiff did not know helped Plaintiff and called an ambulance for him. Shortly thereafter, an ambulance and police vehicles arrived at the scene. Plaintiff was placed on a stretcher, loaded into an ambulance, and transported to Kings Hospital for treatment. A police officer accompanied Plaintiff in the ambulance and unlawfully arrested him without probable cause or legal justification. Plaintiff remained in police custody and was unlawfully handcuffed and shackled to a gurney until March 13, 2014, when he was discharged from the hospital. Immediately thereafter, Plaintiff was transported to the 67th Precinct, where he was detained in a holding cell for several hours. Plaintiff was in so much pain from his wounds that he was transported back to the hospital via an ambulance to receive further treatment. Plaintiff was prescribed pain medication and transported back to the 67th Precinct, where he remained in a holding cell overnight until March 14, 2014. Plaintiff was in severe pain during his detainment because he was not permitted to take the medication just prescribed to him at the hospital.\n\nIn the morning, Plaintiff was transported to Kings County Central Booking. NYPD Officer Garret Gorham, Officer Sean Collins, Officer Gregory Johnson, Sergeant Mark Smith, and several unidentified NYPD officers provided false information to the District Attorney’s office, which initiated the prosecution against Plaintiff. After approximately 12 hours in Central Booking, Plaintiff was arraigned on March 14, 2014, and charged with several crimes based on these false allegations. Plaintiff was unable to post bail immediately, so he remained in police custody until March 16, 2014.
