When Plaintiff exited the store he saw an MTA employee he was distantly familiar with being followed by a man yelling threats and holding a box cutter. When Plaintiff asked if the MTA employee if he was okay the man with the knife turned and began to threaten Plaintiff. Plaintiff was walking to his motorcycle so he could leave when POs John Doe 1 & 2 arrived and Plaintiff informed them what had occurred. A PO asked to search Plaintiff and Plaintiff declined, though Plaintiff did provide his identification on request. Plaintiff was told he had to remain at the scene until a supervisor came. \n\nPOs Luckie, Gaston, and Soto shortly arrived, and PO Luckie told POs Gaston and Soto that Plaintiff should be locked up because he likes to sue, and ordered the other POs to search Plaintiff and take his motorcycle. POs Gaston and Soto illegally did so and discovered a utility knife on Plaintiff's person. Plaintiff was then falsely arrested for possessing a gravity knife. Plaintiff was taken to the 45th Precinct as POs impounded Plaintiff's motorcycle without justification. Plaintiff was put in a holding cell and remained there as other arrestees, including the man who had threatened him with a box cutter, were taken to go before a judge and released hours before Plaintiff. POs held Plaintiff's motorcycle and refused to return it for 4 days, and when Plaintiff's wife arrived at the precinct POs refused to release Plaintiff's belongings to her. These unlawful actions were undertaken by POs in retaliation for Plaintiff's earlier complaint against POS Luckie and Quirk because they engaged in intentional endangerment of Plaintiff ad his daughter.
