Upon police arrival at the scene, Defendant PO Murphy viewed a still shot of the incident and stated his belief that the assailant was Plaintiff Malik Mitchell. Defendant Murphy stated that he recognized Plaintiff Mitchell after arresting him previously. Based on PO Murphy's presumption, Defendant Detective Patterson investigated Plaintiff Mitchell and prepared a photo array for Ms. Ramos to view. After the viewing, Defendant Patterson and other officers drafted a police report stating that Ms. Ramos \"unequivocally and positively identified Malik Mitchell\" as the assailant. \n\nThis police report led to the creation of a wanted poster with Mr. Mitchell's photo. As a result, Mr. Mitchell surrendered himself to the police precinct on November 24, 2020, and was charged. At Mitchell's arraignment, his counsel showed photos comparing Mr. Mitchell with still photos of the assailant who stabbed Ms. Ramos, and despite \"obvious differences,\" the Assistant QCDA argued for excessive bail, which was granted by the court. Mr. Mitchell was held for four days at Rikers Island, forced to sleep on the floor of his crowded holding cell, and denied medical treatment for a potentially fatal blood clot condition despite repeated pleas. \n\nThe QCDA saw the side-by-side photos and postponed the case. Ms. Ramos and another witness also indicated they were not certain in their identification of Mr. Mitchell.
