Defendants put Plaintiff in imminent fear of physical contact by approaching Plaintiff with loaded firearms, and other objects used to physically seize, strike and restrain the plaintiff. Plaintiff was assaulted and had batteries committed against him by the Defendants. Defendants arrested the plaintiff, put tight handcuffs on him that turned his wrists red, restrained him and took him to a police station in the county of the bronx and was held in custody for 5 days before being released. Defendants caused a criminal court complaint to be filed with the goal of falsely accusing Plaintiff of violating criminal laws and the Defendants failed to take reasonable steps to stop the proseuction and maliciously provided false and incomplete information to the DA's office to induce prosecution of the Plaintiff. Defendant Cruz signed the criminal court complaint, Defendant John/ Jane Doe assited in the investigation that led to Plaintiff's arrest, and Defendant Cruz wrongfully claimed that he observed plaintiff on a video committing a crime, and also provided false or incomplete statements claiming he observed the plaintiff committing a crime, which caused the plaintiff to be unlawfully arrested.
