He was stopped and handcuffed by officers of the New York City Police Department, which included Defendant Police Officer Travis Mussaw. Plaintiff was taken to the 101st Precinct where he was interrogated by a detective who told him that he was being charged with criminal possession of a weapon and that he was seen via surveillance camera ditching a gun. Plaintiff asserted his innocence and volunteered to provide his DNA, but his assertions were disregarded. Plaintiff was eventually brought to Queens County Criminal Court where he was arraigned on January 18, 2012 at about 8:00 P.M., and charged with two felony counts of Criminal Possession of a Weapon Second Degree. The criminal complaint alleged that Defendant Police Officer Chris Kearney was the source of the allegation about the gun.
