Plaintiff was promptly arrested, restrained with unreasonably tight handcuffs, and searched unlawfully. No weapons or contraband was discovered on Plaintiff's person as a result of this search and the officers did not articulate a justifiable basis for the stop. Plaintiff McKenzie was transported to the local precinct, where he was placed in a holding cell before being interrogated for over an hour by Defendants about the October 28 shooting.  During this interrogation, Plaintiff vehemently stated that he had not committed the crime and that he had, in fact, been the individual who called 911 at the scene. Plaintiff was then transported to Central Booking where he continued to be detained. \nWhile Plaintiff was being detained, Defendant Officers represented to the DA that Plaintiff engaged in second-degree murder and criminal possession of a firearm. On December 7, 2020 Plaintiff was charged accordingly and sent to Rikers, where he spent 33 months in unlawful custody. Prior to the arrest, Jasmine Berrios had mistakenly reported to the police that the plaintiff had assaulted her on August 29, 2019. She later went to the police precinct and recanted her complaint after realizing it was not the plaintiff but a different person who had assaulted her. On September 4, 2019, the plaintiff went to the 73rd precinct to ensure that the matter had been resolved. After arriving at the precinct, the plaintiff was wrongfully touched, battered, and arrested by the defendants despite the fact that the complaining witness had withdrawn her complaint against the plaintiff and that the plaintiff was innocent. The plaintiff was placed in handcuffs and criminally processed, including invasive procedures such as fingerprinting and photographing. The plaintiff was subsequently transported to Kings County Central Booking where he was again subjected to invasive criminal processing. The defendants fabricated evidence and falsely accused the plaintiff of committing assault and attempted assault in the third degree, menacing in the third degree, and harassment in the second degree. The plaintiff was released after his arraignment but was forced to return to court on numerous occasions to fight the clearly erroneous charges against him. All charges were dismissed in favor of the plaintiff on December 6, 2019. None of the officers were in uniform and did not identify themselves before grabbing Libhart and macing him. The plaintiff was repeatedly punched by Officer Delwy and Officer Dumelle while laying handcuffed on the ground. During this time, none of the officers intervened in the assault. The plaintiff was taken to the 9th Precinct and charged with assault in the second degree against Officer Delwy.
