The officers approached Plaintiff’s vehicle and ordered him to step out with no legal basis for doing so. Plaintiff and his vehicle were illegally searched. P.O. Cannizzarro falsely claimed that he recovered an illegal “billy club” from Plaintiff’s driver’s side door and P.O. Baldares falsely claimed he had recovered an illegal “large fixed blade knife” from underneath the back seat. The “billy club” was in fact a small baseball bat, which is not a per se illegal weapon. The officers arrested Plaintiff for alleged possession of the “weapons,” applying handcuffs with excessive force. At the precinct, the officers unlawfully conducted a strip search and cavity inspection. The officers gave false, misleading and incomplete information to the D.A.’s office, so that Plaintiff would be charged with criminal offenses. On April 11, 2018, the D.A.’s office moved to dismiss all charges against Plaintiff.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.517768/gov.uscourts.nysd.517768.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/15788822/guillen-v-city-of-new-york/"},{"name":"Torres, Jayson vs City of New York, et al.","start_date":"2018-05-16","disposition_date":"2019-06-11","payout_amount":20000,"disposition":"Settlement","docket":"154564/2018","court":"Supreme Court - New York","officer_name":"Baldares, Francisco","summary":"On April 22, 2017 at approximately 5:30 pm, Plaintiff was in the vicinity of East 125th Street and Lexington Avenue in the County of New York, doing nothing illegal or improper, when Defendants NYPD officer Daniel Delacruz, NYPD officer Francisco Bardales, Police Officer John Doe, and Police Officer John Roe stopped, searched, grabbed, assaulted, battered, detained Plaintiff in an aggressive manner and arrested Plaintiff without probable cause, an arrest warrant or legal justification. Plaintiff was stopped and searched solely on the basis of his age and race as part of the Stop Question and Frisk program. Defendants knew that their actions lacked any legal justification in their actions. A criminal complaint was issued against Plaintiff without probable cause and was filed based on fraud, perjury and misrepresentations. Plaintiff was arrested and arraigned after his arrest and was incarcerated for over 24 hours and had to make court appearances. The charges were then terminated in Plaintiff's favor. As a result of Defendants' actions, Plaintiff sustained physical and emotional pain and injuries.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=jTkTScbXjFkJ0eB0Dy9jBQ==","type":"complaint"}]}],"payroll":{"salary":"118056","regular":"117719","overtime":"64706","other":"22088","total":"204514"},"id":"A65R","url":"https://www.50-a.org/officer/A65R"}
