At the above time, Plaintiff was at a funeral at the aforementioned location. Plaintiff stepped outside to move his vehicle that was lawfully parked in the aforementioned location, when Defendant officers approached the vehicle from behind. Defendant officer Nazaire asked the Plaintiff, the owner of the vehicle, for his license and registration, which he provided. When Plaintiff stepped out of his vehicle Defendant officer Nazaire snatched the car keys from the Plaintiffs hand, opened the vehicle door and sat in the drivers seat. Plaintiff asked Defendant officer Nazaire “what are you doing?” and the defendant officer responded by slapping the Plaintiff in the face. Defendant officer Nazaire then stepped out of the vehicle and pushed Plaintiff. Plaintiff, not wanting to have an altercation, placed his hands up in the air. Absent probable cause, Defendant officer Nazaire, with police officers John and Jane Does, roughly grabbed the Plaintiff, slammed the front of his body and right cheek up against the vehicle, put his hands behind his back and handcuffed him. Defendant officers had no lawful basis to detain Plaintiff, who had not broken any laws. At no point did the Defendant Officers recover any drugs, weapons, graffiti instruments, or other illegal contraband from Plaintiff or from a location that was in Plaintiff's possession, custody, or control.  Plaintiff did not resist arrest. Nevertheless, Plaintiff was placed in the back of an NYPD vehicle and transported to the 28th Precinct against his will. Upon his arrival to the 28th Precinct, Plaintiff was placed in a holding room where he was unlawfully searched, fingerprinted, and photographed. While in custody, the defendant officers provided the New York County District Attorney’s Office with the false, misleading and/or incomplete information that Plaintiff committed a crime. Specifically, the Defendant officers falsely stated to the New York County District Attorney’s Office that Plaintiff had possessed a firearm. Plaintiff was held in unlawful custody, at the 28th precinct and Central Booking, for approximately thirty (30) hours.
