When defendant officers stopped and frisked plaintiff and obtained no contraband, instead of releasing plaintiff, plaintiff was cuffed and detained to search for evidence of a crime.  \n\nPlaintiff was then falsely charged by defendant officer Weck of Disorderly Conduct, for running towards plaintiff in a violent manner when body camera footage shows that plaintiff stood completely still with his hands in the air as officers approached him. \n\nThe District Attorney's office declined to prosecute the bogus charge. \n\nOn June 5, 2021, defendant officers of the 40th Precinct including but not limited to defendant officers Hijazi and Juciano pulled over Plaintiff, asked him to step out of his vehicle, and arrested him. Defendant Sgt. Santos responded to the scene and did nothing to prevent the unlawful arrest or detention of Plaintiff. The officers did not look up Plaintiff’s driving record for at least two hours after the\narrest, at which time they used the information to charge Plaintiff with a traffic infraction without conducting any testing on the substance found in the vehicle to\nconfirm its contents, and maliciously charged Plaintiff without probable cause that the substance was, in fact, unlawful. Defendants held Plaintiff for over 24 hours before sending him to arraignment for the improper purpose of gathering evidence to cover up the unlawful stop.\nAll charges arising from this unlawful stop were dismissed in their entirety on the\nnearly two months later, on July 29, 2023. \n\nOn November 11, 2022, Does 1 and 2, both described as\nHispanic males, came to Plaintiff’s Bronx home, entered his bedroom while\nhe was asleep, shined their flashlights in his eyes, and claimed to have a warrant for his arrest. No such warrant ever existed.  At some point, Plaintiff learned that he was suspected of participating in a robbery. But after some time, Plaintiff was told that the case against him was “dismissed.” The Doe Defendants held Plaintiff for an additional 1–2 hours, again without probable cause, claiming that that there was a second warrant that needed to be “cleared” before Plaintiff could leave. Again, no such warrant ever existed. As Plaintiff and the other man were leaving an area where there had been a vigil for a child who had died, they saw two plainclothes officers driving slowly in an unmarked car, staring and slowly starting to follow them. Eventually, Plaintiff and the other man pulled out their cell phones to record, fearing police harassment. They were then forcibly stopped by the officers, without any requests or commands relating to a search or a stop. One officer approached Plaintiff, said nothing, grabbed his cell phone out from his hand, began pushing him, and threw his phone to the ground. The officer had his hand on his gun and continuously told Plaintiff to back up. The officer then left Plaintiff and went to where the other man was being restrained. The officers committed a violent assault and takedown of the other man, grabbing him forcibly by a chain around his neck, beating and kicking him, and pulling his coat over his head. The man was pepper sprayed, arrested, and taken to a police station, while still wearing a mask filled with pepper spray. One NYPD officer involved in the stop, harassment, initiation and persistence of the use of force and the arrest was (later retired) NYPD Lieutenant Eric S. Dym. The officers selectively applied enforcement practices in an intentionally discriminatory and race-based manner. \n\nAfter waiting for hours, the man eventually received medical attention, and later received a desk appearance ticket. The case was later dismissed. Plaintiff and the other man experienced pain and suffering, including physical injury, anxiety, fear, and stress, from the officers’ unprovoked attack. As he was lead to the vehicle, the officers purposely lifted his arms high behind his back, causing his body to bend painfully in half. The officers ignored plaintiff's complaints that the handcuffs were applied too tightly; instead they grabbed him by the cuffs and added leg shackles. Plaintiff was searched at the precinct, processed for arrest, and held for ~3 hours. He was released and charged with disorderly conduct. All charges were dismissed on April 28, 2021. Dym’s conduct, Officer Elena Pelengaris, an officer in Lt. Dym’s command, falsely accused Ms. Grant of committing disorderly conduct. There was no basis for the charge and the criminal case was later dismissed. Officer Pelengaris also issued Ms. Grant two civil summonses falsely accusing her of being in a park after hours and drinking an alcoholic beverage, neither of which was true. Mr. Lamont was attempting to enter the building at 680 Tinton Avenue when we was confronted and assaulted by POs Olsen, Dym, Suarez and John/Jane Doe.  The POs forcibly grabbed and threw Mr. Lamont to the ground, kneed him in his back, and punched his head and jaw.  They continued to strike Mr. Lamont even after tightly handcuffing him.  At no time during this assault did the POs identify themselves or provide a reason for conducting such assault. They continued to kick and punch Mr. Lamont in his body while being tightly handcuffed and taken in a police van. Mr. Lamont repeatedly asked for the handcuffs to be loosened, but the defendants did not do so. The POs created a false narrative and charged Mr. Lamont with various claims. While in custody, Mr. Lamont sought medical treatment from an EMT at PSA 7 precinct for the injuries he sustained due to the POs excessive use of force. After the police stated they would run their name for warrants, then the police officer with the crew cut found ablack bag in a grassy area behind the bench and announced they were all going in.During this time, Police Officer John Olsen and Lieutenant Eric Dym from PSA 7, along with other unnamed officers, JOHN/JANE DOE I-V, approached Plaintiff. Without any warrant, probable cause, or legal justification, the officers allegedly detained, handcuffed, and searched Plaintiff in an aggressive and excessive manner.The officers placed Plaintiff in “imminent fear of physical contact by approaching [him] with their loaded firearms, outstretched limbs and other objects.” Plaintiff was tightly handcuffed, sustaining bruises on his wrists, and subjected to a strip search with a cavity inspection while in custody. At the precinct, she was told to wait by an officer and while waiting saw Defendant Officers and informed the officer she spoke to that the Defendant Officers were present at the incident for which is the basis of her complaint and wanted to file a complaint against them too. After a few minutes, Defendant officers asked plaintiff to put her bad down and arms behind her back, and arrested her; she was tightly handcuffed, searched, and placed in a holding cell while handcuffed; she was pushed and batterd. Although Plaintiff's attorney arrived, Officers ignored the attorney and attempted to question Plaintiff without his lawyer present. Plaintiff heard and recorded officers acknowledging that Plaintiff never got within 15-20 feet of them while recording Defendants interacting with the two civilians yet determining they would still charge Plaintiff with interference. \n\nDefendants did not issue a desk appearance ticket and instead kept plaintiff in custody for approximately 24 hours. At 9pm on August 6, Plaintiff was released from custody without explanation or charges. But that same night, Defendants rearrested Plaintiff after making false statements to secure charges against Plaintiff. Plaintiff received notice that Defendants were attempting to unlock his phone despite Defendants not having a warrant.
