PO Michael Vasquez, PO Pierre Senat, and PO Francesco Monastra were in an unmarked police vehicle pursuing an individual in an ATV when their negligence caused the ATV to collide with Plaintiff's vehicle. Plaintiff lawfully filmed the scene and did not interfere with police activity. Regardless, POs attempted to stop Plaintiff from filming. When Plaintiff refused unlawful orders to leave PO Vazquez ordered Plaintiff to put his hands behind his back for \"standing in the street\" and suddenly violently propelled Plaintiff's head, neck, and upper body into the street in a \"suplex\" move. PO Vasquez then sat on Plaintiff while beating him together with PO Senat. PO Vasquez intentionally deactivated his body-worn camera when he began the assault. Sgt. Tatiana Cruz and Sgt. Louis Guglielmo arrived and approved of Plaintiff's false arrest. POs drove Plaintiff's car to the precinct to conduct an illegal search. Plaintiff was also taken into custody and was in and out of consciousness due to his head injuries. Plaintiff was maliciously prosecuted but the District Attorney declined to pursue the charges and Plaintiff was released without being arraigned. Despite no evidence of weapons or contraband, Officer Senat claimed that Purcell-Holmes had swerved and obstructed his view. His vehicle was then searched by several officers. Purcell-Holmes was subsequently handcuffed and taken to the 47th Precinct, where he was charged with possession of a loaded firearm. He was held at Rikers Island until his bail was posted, and his case remained open for 14 months. During this time, he experienced job loss, emotional stress, and was diagnosed with diabetes.
