Officer Nelson acknowledged that the cafe was not the cause of any such crimes in the past, but threatened shutting down the cafe and arresting all attendees if an event occurred. Officer Nelson ultimately demanded that no other major events ever be held at the cafe. A similar shutdown occurred on February 18, 2017, even though the liquor license and occupancy count were lawful, and on that instance defendant officers damaged plumbing in the mens room. Chou, and Officer Aurel Hoxha (Shield No. 13176), initiated and maintained false criminal proceedings. Specifically, defendant-Officer Hoxha alleged that they witnessed the plaintiff unlawfully possess, sell, store, and sell alcohol without a liquor license. Defendants Hoxha and Chou were made these claims deliberately to prevent, curtail, or harass Caribbean owned businesses from engaging in ethnically and culturally-styled music and entertainment events. Additionally named, though whose actions are not specifically stated are Lt. Lombardi and Officer Nelson of the 67th Precinct. On January 29, 2017, plaintiff was arraigned and released without bail. Plaintiff made four (4) additional court appearances before the Kings County Criminal Court. Plaintiff's wife was asked to get up, which she expressed that she was unable to do due to the handcuffs. Defendant officer Nelson then grabbed her breasts from behind and lifted her up. Defendant officer Nelson then searched the plaintiff's car without his consent and seized a canister of mace. An ambulance then arrived to take the plaintiff and plaintiff's wife to the hospital, where Defendant officer Nelson falsely accused plaintiff of being intoxicated. A male police officer later responded to the scene and spoke to defendant Nelson in private. Defendant Nelson released plaintiff.
