Defendant officers also included Defendants Police Officer Christopher Malzahn, Ariel Mallol, Ashley Delia, and Sergeant Byan Ortiz. \n\n\nDefendants used excessive force by, amongst other things, yanking Plaintiff by the arms and torso, throwing Plaintiff to the ground, placing handcuffs upon Plaintiff’s wrists in an excessively and abusively tight manner, threatening the use of an electronic taser device despite the fact that Plaintiff was not resisting arrest and was already handcuffed, and suffer other injuries. Additionally, Defendant officer threatened to use a taser on Plaintiff. While Plaintiff was in custody, the Defendant Police Officers provided the Bronx County DA's Office with false, misleading, and/or incomplete information that Plaintiff committed a crime. Plaintiff was unlawfully detained for approximately 28 hours.
