Richard Hewitt unlawfully stopped, questioned, frisked, searched, seized, falsely arrested, and falsely imprisoned Plaintiffs without legal justification. Other unnamed POs observed the illegal actions and did nothing to prevent them. Plaintiffs were handcuffed and searched without result. POs then transported Plaintiffs to the 52 Precinct where they were criminally processed and detained for approximately 7 hours. Plaintiffs were maliciously prosecuted and each forced to return to court until their charges were ultimately dismissed.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=buAzW73qHqL0mdnY4GE8og==","type":"complaint"}]},{"name":"Miller, Bernard vs City of New York, et al.","start_date":"2014-12-30","disposition_date":"2015-07-02","payout_amount":80000,"disposition":"Settlement","docket":"024172/2014E","court":"Supreme Court - Bronx","officer_name":"Hewitt, Richard","summary":"On June 5, 2013, while Plaintiff was lawfully walking, defendant officers racially profiled Plaintiff and without provocation or legal justification, grabbed him, jumped on top of him and punched him in the face repeatedly. This caused Plaintiff to suffer serious physical injuries, including but not limited to a laceration over his left eye which bled profusely. The defendant officers neglected to provide plaintiff with medical attention for the injuries. Instead, defendant officers frisked and search Plaintiff. Although they did not recover any illegal drugs, weapons, or contraband, they handcuffed and arrested him. Upon arrival to the precinct, the defendant officers unlawfully strip-searched Plaintiff without reasonable suspicion or probably cause to believe plaintiff possessed any illegal drugs, weapons or contraband. Thereafter, defendant officers were forced to call an ambulance and Plaintiff was transported to a hospital for medical treatment. Once discharged from the hospital, defendant officers forced plaintiff to submit to a second strip search, for no reason other than to embarrass the plaintiff. Defendant officer Rodriguez falsely communicated to the DA’s Office that the plaintiff had committed a crime despite knowing that they lacked legal basis to stop Plaintiff and to allege Plaintiff had committed a crime.
