When he arrived though, Instead of releasing his properties to him, defendant officers arrested Plaintiff and interrogated him asking him questions about other people and\nincidents. Plaintiff duly informed defendant officers that he was at the precinct to pick up his properties as agreed and Defendant officers in response assaulted Plaintiff forcibly grabbing, punching, pushing, pulling, kicking, and shoving him. Plaintiff sustained serious injuries from the assault and was transported to the hospital where he was seen and/or treated for his injuries. They then performed a search on him which did not recover any contraband, but they still continued to detain Plaintiff. The officers also falsely stated to the prosecutors that the plaintiff committed ‘Obstructing governmental administration in the second degree’ and ‘Resisting arrest’ and then falsified police reports, which caused Plaintiff to be criminally charged. Plaintiff is not fluent in English. Several uniformed POs entered the restaurant and exited with an arrested customer. The PO's reentered and asked Plaintiff for ID, one saying if she doesn't have ID she will be sent to jail. They raised their voices and spoke in intimidating tones. \n\nPlaintiff was afraid and attempted to call her husband, a PO grabbed her phone and threw it onto the counter. A PO forcefully grabbed Plaintiff's arms and twisted them to handcuff her behind her back. Plaintiff cried, saying she was in pain from the PO's handling because she's pregnant. During the arrest, Plaintiff fell to the floor hitting her back and buttock. A PO grabbed her by the arm to pick her up from the floor. She did not resist arrest, though she protected her abdomen in fear of her unborn child being injured. Plaintiff's person was searched twice, the PO's frisked her entire body, putting their hands in her pockets. Plaintiff was taken from the restaurant and shoved into a police van. Defendant PO's returned inside to search the restaurant. They found Plaintiff's ID in her bag. 20 minutes later, Plaintiff was taken out of the van and handcuffs removed. She returned inside and a PO gave her a ticket for drinking alcohol in the restaurant.\n\nShe went home and felt unwell, with vomiting and stomach pain. She called 911 and was transported to Jacobi Medical Center where she was treated for the physical trauma of the arrest, given medications, and saw a psychologist.
