Plaintiff and his friend were arrested for theft of services. Plaintiff had attempted to pay for their meal using a VISA gift card which had sufficient funds to pay for the meal. Plaintiff was taken to the precinct for processing, arraigned, and released on his own recognizance. Plaintiff had been in NYPD custody for a total of 29 hours. On January 9th, 2019, the charges against Plaintiff were sealed and dismissed. \nOn or about March 4th, 2017, Plaintiff was lawfully leaving the premises of his friend's apartment when he was approached by PO \"John Doe\" and PO \"Jane Doe\" of the NYPD. Plaintiff had been invited to the building by his friend who lived there and allowed access to the premises. Nevertheless, Plaintiff was arrested for trespassing and taken to the local precinct. Plaintiff was held for approximately 25 hours in NYPD custody. At arraignment, Plaintiff was released on his own recognizance.
