The protest included peaceful marching along streets that the NYPD had blocked off with cars. In the evening, the NYPD abruptly halted the protest, and pushed protestors, which resulted in a crush of people, and the plaintiff was trapped in the crowd. When the plaintiff was helping someone who had fallen down, he was pushed by an NYPD officer and it caused the plaintiff to fall backwards. He could not move or bear weight on his right leg right after. He moved to a sidewalk, but was soon caught in another crush of people, caused by the NYPD officers' push. The plaintiff tried to protect his injured leg in this crowd and while doing so, one of the officers struck him in the face and placed him under arrest. He was handcuffed and one or more of the officers excessively tightened the metal handcuffs. The plaintiff complained to the officers about his leg and requested medical attention while being moved to and boarding an NYPD bus but was ignored. The plaintiff was released from police custody approximately 3 hours after the arrest, with criminal court desk tickets.
