When Plaintiff pulled up in front of his home, defendants, NYPD officers approached his car with their guns drawn. Plaintiff scared honked his car to alert his family. Plaintiff's father exited the house and then Plaintiff opened the car door and when he did the NYPD officers John and Jane Does, Dustin Diaz and Mark Whirl dragged him out of his car and physically assaulted him, causing injuries to his body and face and then arrested him. Plaintiff was also tasered and struck. Defendants hit plaintiff's head, pounded his head and body into the street. Plaintiff was also wrongfully arrested. The criminal charges were dismissed on August 12, 2024. Two defendants, NYPD officers Dustin Diaz and Mark Whirl gave conflicting accounts of what led to their decision to arrest the plaintiff, and based on this NYPD officers maliciously prosecuted the Plaintiff. There were also video recordings of the incident, and these videos undermined Defendants' account. Plaintiff attempted to provide a key to the new lock to the individual, when the individual threatened to shoot him. Plaintiff retreated from the building and called 911. The individual who threatened Plaintiff also called 911 and falsely reported that Plaintiff had brandished a firearm at the individual. Several plain clothed NYPD officers arrived at the scene who verified that the Plaintiff was not armed. One of the Defendant officers, Phillips, continued to focus on whether Plaintiff was armed and did not investigate the threats made to Plaintiff by the individual. After further investigation, Defendant Phillips placed Plaintiff under arrest for criminal possession of a firearm, menacing, and harassment. The other officers present at the scene did nothing to stop this injustice. \n\nPlaintiff was arrested and taken to the precinct and eventually Central Booking. A protective order was put in place preventing Plaintiff from entering his property and interacting with the individual that had threatened Plaintiff. As a result of his false arrest, Plaintiff's Global Entry access was revoked, which resulted in Plaintiff's detainment upon reentering the US at a later date.
