Plaintiff sought and received an order to show cause on May 20, 2019. On June 11. 2019, the City Marshall came to Plaintiffs' home and told Plaintiff Ms. Palmer that she was evicted and had to leave the house. Despite having the order, the city Marshall took possession of Plaintiffs' home. The next day Plaintiffs were able to get back to their house after showing the Marshall's office the order. However, the locks of their home had been changed. At a hearing, Plaintiffs showed the state Supreme Court in Kings Count that they filed for bankruptcy and delayed the hearing until July 24, 2019. But on June 27, 2019, NYPD came back to the house to evict Plaintiffs. When Plaintiff Mr. Palmer showed the order and refused to leave, NYPD pushed, manhandled, and handcuffed Palmer with no cause. They brought Plaintiff to the police precinct in Brooklyn and told him that if he did not tell his wife to leave the house that they would arrest her as well. Ms. Palmer returned home to find Defendant Reggie who was taking the home hanging the locks. When the Police arrived and told her to leave Plaintiff Ms. Palmer left her home and went to stay with her relatives. Plaintiff Mr. Palmer was held until 1 am and taken to criminal court in the evening. Mr. Palmer had a nervous breakdown. Their belonging and home were seized unlawfully including gadgets, jewelry, and furniture. Ms. Palmer lost access to her medicine she used to treat her diabetes.
