Because the two were uncomfortable waiting inside the laundromat, they decided to wait by a well-lit bus stop nearby, where they were approached by Defendant officers Donofrio and Hurst. Plaintiff explained to the officers why they were there, at which point Defendant Donofrio accused Plaintiff and her sister of drinking from a container that was underneath the bench of the bus stop. Plaintiff denied the accusation, at which point Defendant Donofrio accused Plaintiff of lying and told her he was going to arrest her. Defendant Donofrio did not inform Plaintiff why she was being arrested and called for backup. A short time later, several other officers arrived. Defendant Donofrio then tightly handcuffed Plaintiff and refused to loosen said handcuffs at Plaintiff’s request. Plaintiff was transported to the 32nd precinct, where she was processed and taken to central bookings.
