Lucchesi, P.O. Galindosanchez, P.O. Martino, P.O. Hong and P.O. John Doe 1-10. At the time of the incident, the Plaintiff was mentally impaired by psychological issues and/or intoxicated by some unknown substance. The aforementioned Defendant officers placed the Plaintiff under arrest by handcuffing his arms tightly behind his back and unlawfully searched him without probable cause, upon which no contraband was found on the Plaintiff. The Defendant officers assaulted the Plaintiff, while he was restrained in handcuffs, causing severe injury to the Plaintiff’s foot, ankle, and leg and also punched and kicked the Plaintiff multiple times about the body. Consequently, the Plaintiff’s ankle was fractured, resulting in multiple surgeries, swelling and multiple abrasions and lacerations, at least one of which required stitches. The Plaintiff was taken to Woodhull Hospital to get evaluated as an emotionally disturbed person, where he was handcuffed to a hospital gurney and held for several hours for treatment before being transported to a nearby precinct. At the precinct, he was searched and confined in a holding cell for several hours. The Defendant officers provided false and misleading reports to the DAs office and initiated a malicious prosecution against the Plaintiff, where he was falsely charged with Assault, Attempted Assault, Harassment, Burglary, Criminal Mischief, Obstructing Governmental Administration and Criminal Trespass.
