In response to the call, Officers Farley and Ransunain came. Cobas alleged that Mr. Borges had banged on her door and made threats because Mr. Borges believed one of Ms. Cobas’ children blocked his parking spot. The officers observed Ms. Cobas’ undamaged front door, made a brief investigation, and left without doing anything else. Ms. Cobas, unhappy with the officers’ inaction, went to file a false police report in the 109th precinct regarding the same incident. Shortly after the complaint was filed, Detective Seel was assigned to investigate the claims and under the supervision and approval of Sergeant Andre and/or John & Jane Doe 1-5, came to the conclusion that there was probable cause to arrest Mr. Borges for the incident – Detective Seel relied on photos provided that showed the doors were damaged, though the doors were only unhinged in the photographs, not damaged. Detective Seel failed to speak with the officers who responded to the event. On October 3, 2017, Detective Seel and John Doe #1 arrested Mr. Borges for menacing in the third degree and criminal mischief. Mr. Borges was arraigned on October 4, 2017 – he pleaded not guilty. On January 23, 2018, upon a motion of Mr. Borges’ attorney and consent of the DA, the Court dismissed all charges against Mr. Borges. Although released on his own recognizance following the October 3, 2017 arraignment, on October 16, 2017, Mr. Borges violated parole and was taken into custody on October 16, 2017, for his arrest on the September 8th matter. A preliminary hearing was held on October 23 where probable cause to support the allegations was found.
