Plaintiff asked the POs what was going on, and the POs responded that they'd been looking for him. Without any Miranda warnings, the POs placed Plaintiff in the back of the police vehicle and kept him in handcuffs for two hours while they continued to patrol the neighborhood. After two hours, POs took Plaintiff to the precinct and charged him with (1) Criminal Sale of a Controlled Substance (crack cocaine) and (2) Criminal Possession of a Controlled Substance.\n\nThese same POs had been \"stopping and frisking\" Plaintiff on a weekly basis since 2010—routinely detaining him, patting him down, pushing him against a wall, grabbing his genitals, and ordering him to take off his shoes without reasonable suspicion and often in view of his family, friends, and neighbors. In the wake of Plaintiff's January 9, 2013, arrest, PO Lambert improperly and inaccurately identified Plaintiff as having sold the crack cocaine relevant to the first charge on December 6, 2012; indeed, he did not know the other individual (the buyer) in that transaction. Regarding the second charge, the POs claimed that when they arrested Plaintiff on January 9, 2013, they found a bag of crack cocaine in the center console of his vehicle, but that substance was never submitted for lab analysis, and that search was conducted without a warrant. Plaintiff was detained for over 1.5 months despite having no involvement in drug-related transactions on the days charged. He was eventually released when his family posted $5,000 bond.
