On the date of the incident, Mr. Jones was unlawfully pulled over by Police Officer Bonifacio while he was lawfully driving in his vehicle in obeyance of all traffic laws. During the traffic stop, Defendant Bonifacio ordered Mr. Jones to step out of the vehicle. When Mr. Jones complied with the order, the Defendants violently contorted Plaintiff’s arms and wrists behind his back to which they affixed metal handcuffs in an excessively tight fashion, which caused Plaintiff to sustain substantial physical pain and injuries to his back, neck, arms, hands, and wrists. Mr. Jones complained several times that the handcuffs were too tight and each time the officers refused to loosen the handcuffs. Mr. Jones was then illegally searched on the side of the road. Mr. Jones was taken to the 24th NYPD Precinct where he was searched, photographed, fingerprinted, strip-searched, placed in a cell, and unlawfully questioned.\nDefendant Bonifacio lacked any probable cause or reasonable suspicion to stop, seize or arrest Plaintiff, because defendants never observed Plaintiff commit any crime or violation of the law. Mr. Jones maintains that the defendant police officers’ illegal actions were racially motivated and that they intentionally discriminated against him because he is an African American. Defendant Bonifacio engaged in fraud, the suppression of evidence, perjury, the gross deviation from acceptable police conduct, and other conduct undertaken in bad faith, including the withholding of other video surveillance recordings, witness statements or accounts, which all directly contradict the false allegations against him by defendant police officers. Defendants applied handcuffs to Plaintiff in an excessively forceful and tight fashion. upon arriving at the precinct, Defendants conducted or authorized an illegal strip search and cavity inspection of Plaintiff. Defendant Bonifacio signed the accusatory instrument, and Defendants all gave knowingly and intentionally false, misleading, or incomplete information to the DA's office that Plaintiff was in possession of an illicit air pistol that duplicated a real firearm.
