Plaintiff resided at the Sound View Housing Complex at Sound View Avenue, and booked a car service trip on the Excellent app. After being picked up by his driver, who was also Black, the car traveled one block up Watson avenue before being pulled over by Defendants Ramos, Brown, and Vassallo in an unmarked black car. Plaintiff overheard the officers speaking to the driver about vehicle license plate and tail defects and noting that plaintiff was not wearing his seat belt, causing him to affix his seat belt. When Defendant Vassallo shined a flashlight into the backseat, plaintiff began recording the interaction on his cellphone. \n\nDefendant Brown reached into the back seat of the car through the rear window and twisted plaintiff's arm, twisting it in an effort to reach plaintiff's cell phone. Defendant Vassallo pulled plaintiff from the car, Defendant Ramos grabbed plaintiff's neck and punched plaintiff in the ribs and stomach, and defendants seized plaintiff's cell phone. Defendants then frisked plaintiff and checked his pockets, finding no contraband or weapons. Plaintiff was subjected to overly tight handcuffs and transported to the 43rd Precinct while being taunted. Once arrived at the precinct, plaintiff was forcibly propelled towards the front desk, where Defendant Lt. Cesar Imbert did nothing to reprimand Defendants Ramos, Brown, or Vassallo for their conduct. Plaintiff was issued a Desk Appearance Ticket by Defendant Ramos on Feb. 17, 2021, in which he was informed he would be charged with obstruction of governmental administration, and the ticket was approved by NYPD Lt. Cesar Imbert. While Plaintiff was speaking with his friends, defendants Police Officers VELZEZ, BROWN and DOES approached one of Plaintiff's friends and arrested him. The Plaintiff attempted to video the actions of PO VELEZ, BROWN and DOES when he was tasered to his chest by the Defendants. The Defendants had no probable cause or reasonable suspicion that the plaintiff was engaged in an illegal activity. Despite the absence of any evidence of wrongdoing by the Plaintiff, the Defendants formally arrested the Plaintiff and transported him to the 43 precinct. After being held for several hours at the 43 precinct into a cell, Plaintiff was transported to Bronx County Central Booking where he was again placed into a cell with other prisoners.  The plaintiff was released from custody on March 15, 2021after the Office of the Bronx County District Attorney declined to prosecute the arrest.
