While walking down the street, the defendants NYPD police officer Timothy Deck, and NYPD police officers John Does #1-10, dressed in plain clothing, suddenly grabbed the plaintiff. The defendants had no probable/reasonable cause or justifiable reason to grab the plaintiff. The defendants did not announce themselves as police officers but still grabbed the plaintiff, handcuffed him, and threw him into a vehicle. While ambushing the plaintiff and throwing the plaintiff into the vehicle, the defendants repeatedly slammed the plaintiff's left foot into the car door. Although the plaintiff pled for information while being thrown into the vehicle, none of the defendants told the plaintiff he was being arrested, the reason for his arrest, or where they were taking him. The defendants transported the plaintiff to the 83rd precinct, where he was held for 12 hours before being transported to Central Booking. The plaintiff stayed at Central Booking for 12 hours before being released and after seeing a judge.\n\n While the plaintiff waited to see a judge, the defendants made false statements and a false criminal complaint to the prosecutors at the Kings County District Attorney's Office stating that the plaintiff possessed a controlled substance on February 11th, 2021 to get him maliciously prosecuted. After the plaintiff's release, he went to Kings County Hospital to address the severe pain the foot felt after the defendants slammed it into their car door. Kings County Hospital medical officials noted that the plaintiff had soft-tissue swelling to his ankle and provided the plaintiff with medical treatment via crutches. At the time of his hearing, approximately six months after his arrest, the plaintiff still required the use of a cane/crutches due to the pain in his foot and attended weekly physical therapy. Before his arrest, the plaintiff rigorously exercised but could no longer do so.
