At the roadblock, PO Howard Roth and PO Edyta Pawlicki ordered Plaintiff to stop her car and produce driver's license and registration. As Plaintiff reached into the glove compartment, she took out pepper spray to look for the documents. PO Roth then ordered Plaintiff to exit the vehicle, placed her in handcuffs and arrested her for allegedly violating NY state law by possessing the pepper spray. Plaintiff was diagnosed with multiple sclerosis approximately 12 years before the incident. PO Roth did not allow Plaintiff to take or use her cane, even though Plaintiff informed PO Roth that she was medically required to use her cane to walk more easily.\n\nAt the 34th Precinct, POs Roth and Pawlicki made Plaintiff walk up three flights of stairs, three separate times, without use of her cane, because the elevator was not working and there was no fingerprinting machine on the first floor of the Precinct. The plaintiff was then kept in a cold, unheated cell for approximately nine hours, shivering from the cold and crying. Plaintiff was released approximately 9 hours after she was arrested. She missed time from work and had to seek medical attention. Defendant officer Scheublin then called EMS staff for Plaintiff and told her that she had to submit to an exam by EMS staff, despite Plaintiff's refusal of treatment. Plaintiff, feeling threatened by Defendant officers, eventually acceded and was transported to a hospital via ambulance. At the hospital, Plaintiff learned that Defendant officers had lied and told staff that she was attempting to physically harm herself and told officers that she wanted to hurt herself.
