The Defendants then transported Mr. Vasquez against his will to a police station and/or a Correctional Facility in the County of New York and there charged him with the crimes. Mr. Vasquez was then held in custody over the course of fourteen (14) days until he was released. The Defendants intentionally confined Mr. Vasquez without his consent, the confinement was not otherwise privileged by law and, at all times, Mr. Vasquez was conscious of his confinement.\n\nThe Defendants caused the prosecution of Mr. Vasquez without any\nprobable cause whatsoever, by filing or causing a criminal court complaint to\nbe filed in the Criminal Court of the City of New York, New York County,\nfor the purpose of falsely accusing Mr. Vasquez of violations of the criminal\nlaws of the State of New York. As a result of the malicious prosecution, Mr. Vasquez was deprived of his liberty and suffered the humiliation, mental anguish, indignity and frustration of an unjust criminal prosecution. Defendants exited their vehicle and began searching and questioning Plaintiff. The officers then pushed plaintiff, grabbed him, and struck him on his body. The defendants also slammed the plaintiff’s head to the ground, breaking his glasses. They also kneed plaintiff in his back and twisted his arms behind his back. Plaintiff repeatedly asked they officers why they were beating and arresting him, and he received no response. The officers then, with no explanation, applied excessively tight handcuffs to plaintiff and formally arrested him. \n\nPlaintiff was then taken to the station house of the 25th Precinct where he\nwas held for several hours and searched. No guns or other contraband was found. From New York County Central Booking, plaintiff was transferred to\nBellevue Hospital to receive treatment for the injuries he sustained at the hands of the defendants. Plaintiff was then transferred back to New York County Central Booking where he was arraigned on a criminal complaint made on the basis of false allegations supplied by each of the named defendants. Plaintiff was charged pursuant to these fabricated statements. It is not alleged in the criminal complaint that plaintiff possessed drugs or exchanged money for drugs. Yet, he was charged with criminal sale and criminal possession. He was also improperly charged with resisting arrest.
